Shepherd Bend Mining, LLC is proposing an expansive strip coal mine, substantially located on property belonging to the University of Alabama, and directly across from the Birmingham Water Works Board’s Mulberry Fork drinking water intake. There is a high potential for hazardous mining-related pollutants to contaminate the river right across from Birmingham’s drinking water intake, as well as threaten the water quality, wildlife habitat, recreation, aesthetics and way of life for residents along the Black Warrior River. The mine is proposed to be an immense 1,773 acres with 29 discharge points. Shepherd Bend Mining, LLC is owned by members of the Drummond Coal Company family.<span style="text-decoration: line-through;"><del datetime="2011-09-21T11:47" cite="mailto:Allie%20Klein"> </del></span><br />

<strong><strong>12/13/07:</strong></strong> Black Warrior Riverkeeper, the Birmingham Water Works Board, Birmingham water users, local property owners, recreators and concerned citizens officially oppose the permit and request a public hearing.<br />
<strong>07/21/08:</strong> Alabama Department of Environmental Management issues the <a href="http://www.blackwarriorriver.org/pdf/ShepherdBendADEMPermit.pdf">wastewater discharge permit</a> without a public hearing, providing a response to public comments or sending a notice of permit issuance to stakeholders involved in the permitting process.<br />
<strong>09/10/08:</strong> Without a requisite Alabama Surface Mining Commission permit, the Shepherd Bend Mining LLC was granted a <a href="http://www.usace.army.mil/CECW/Documents/cecwo/reg/nwp/NWP_21_2007.pdf">Nationwide Permit 21</a> permit by the U.S. Army Corps of Engineers.<br />
<strong>12/22/08</strong>: Black Warrior Riverkeeper (represented by the <a href="http://www.southernenvironment.org/alabama/">Southern Environmental Law Center</a>) appeals the ADEM wastewater discharge permit. The Alabama Department of Environmental Management’s hearing officer will send a recommendation to the Alabama <a href="http://www.adem.alabama.gov/commission/default.cnt">Environmental Management Commission</a>, which oversees the Alabama Department of Environmental Management. The Environmental Management Commission is charged with developing the state’s environmental policy and hearing administrative appeals of permits.<br />
<strong>08/25/09:</strong> The Southern Environmental Law Center, on behalf of Black Warrior Riverkeeper, sends letter of objection to the Army Corps of Engineers’ Nationwide Permit 21, contesting the administrative action.<br />
<strong>12/08/09:</strong> The Nationwide Permit 21 coverage for the Shepherd Bend Mine is suspended by the Army Corps of Engineers.<br />
<strong>05/19/10: </strong>Shepherd Bend Mining, LLC submits a permit application to the<a href="http://www.surface-mining.state.al.us/">Alabama Surface Mining Commission</a>.<br />
<strong>06/16/10: </strong>Black Warrior Riverkeeper, the Birmingham Water Works Board, Birmingham water users, local property owners, recreators and concerned citizens from the Tuscaloosa area officially <span style="text-decoration: underline;">oppose the permit</span> and request a public hearing.<br />
<strong>07/09/10</strong>: Shepherd Bend Mining, LLC’s Nationwide Permit 21 coverage is re-issued by the Corps of Engineers.<br />
<strong>08/19/10</strong>: The <a href="http://www.surface-mining.state.al.us/">Alabama Surface Mining Commission</a> <a href="http://blog.al.com/spotnews/2010/08/alabama_surface_mining_commiss_1.html">hosts a public hearing</a>on Shepherd Bend Mining, LLC’s <span style="text-decoration: underline;">application</span> for the mine.<br />
<strong>09/15/10:</strong> <a href="http://www.facebook.com/group.php?gid=4775074380">Students at the University of Alabama Birmingham</a> <a href="http://picasaweb.google.com/blackwarriorriverkeeper/UABShepherdBendMineProtest?feat=directlink">protest</a> the location of the mine, which would be partially located on University property. Student leaders collected more than 700 signatures in opposition of the mine and presented them to the University.<br />

<strong>7/7/11-</strong><strong> </strong>Dr. Robert E. Witt, President of the University of Alabama, shares his concerns about the Shepherd Bend Mine during a speech to the Rotaract Club of Birmingham. While not directly stating that UA would <em>never</em> lease land or minerals for the Shepherd Bend Mine, Dr. Witt does make surprisingly strong and encouraging statements about the feedback he has received from students, scientists, cities, organizations, and other citizens opposing the mine proposal.  He expresses what appears to be genuine interest in helping protect the river and Birmingham’s drinking water, thereby demonstrating stewardship to UA students.  Black Warrior Riverkeeper encourages citizens to thank Dr. Witt (205-348-5100, <a href="mailto:witt@pres.ua.edu">witt@pres.ua.edu</a>) for his concerns, and to keep asking him not to lease/sell UA’s land or minerals to Shepherd Bend Mining LLC.<br />
<strong>7/22/11-</strong><strong> </strong>An administrative Hearing Officer gives a favorable recommendation for ADEM’s permit.  Black Warrior Riverkeeper and Southern Environmental Law Center plan to appeal if the Environmental Management Commission rubber-stamps that decision.<br />
<strong>8/19/11:</strong> The Alabama Environmental Management Commission (EMC), the board which oversees the Alabama Department of Environmental Management (ADEM), rubber stamps ADEM’s Shepherd Bend Mine wastewater discharge permit.  The EMC takes 1 minute and 20 seconds to do this at their public meeting, with no discussion.<br />

TOLEDO &#8212; Environmentalists and charter fishing captains expect Lake Erie&#8217;s fish population to climb with the closing of coal-burning units at a power plant near the mouth of the lake&#8217;s biggest tributary.<br />
The plant, which is being shut down by its operator because of new air pollution rules, sucks in billions of gallons of water each year and kills millions of fish near some of the lake&#8217;s most popular fishing spots.<br />
Environmental groups have said for years that the fish kills have contributed to declining levels of both yellow perch and walleye, two prized fish that draw anglers from around the Midwest. Elevated levels of metals have been found in groundwater near ash basins at all 14 N.C. coal-fired power plants, state regulators say after intensified monitoring.<br />
Coal ash holds metals that can be toxic in high doses. But the elements most widely detected at the power plants, iron and manganese, also occur naturally and aren&#8217;t considered health risks.<br />
State regulators now have to figure out which is affecting the wells.<br />
Ash became an environmental lightning rod after a massive spill in East Tennessee in 2008. </strong>U.S. District Judge Irene Keeley denied Mon Power&#8217;s request to dismiss the lawsuit in a ruling issued Tuesday.<strong><br />

The rules require coal- and oil-fired power plants to lower emissions of 84 different toxic chemicals to levels no higher than those emitted by the cleanest 12% of plants. Reporting from Washington— The <a title="U.S. Environmental Protection Agency" href="http://www.latimes.com/topic/environmental-issues/environmental-cleanup/u.s.-environmental-protection-agency-ORGOV000048.topic">Environmental Protection Agency</a> is expected Friday to approve a tough new rule to limit emissions of mercury, arsenic and other toxic substances from the country&#8217;s power plants, according to people with knowledge of the new standard.<br />

The truth is that U.S. coal-fired power plants spew 48 tons of mercury into our environment every year and are the largest source of mercury air emissions in the U.S. And recent EPA-sponsored studies have shown that around 70% of these mercury emissions are ending up in waterways that are within a couple of hundred miles of these plants, leading to mercury hotspots across the country.</p>
<p>Mercury emissions from the 1,100 U.S. coal-fired power plants account for more than 40% of all airborne mercury emissions in the nation. This mercury falls into our rivers, lakes and oceans &#8211; polluting our water, our food, our bodies and our babies.  Just 1/70th of a teaspoon &#8211; a single gram &#8211; of mercury in a 25-acre lake can make the fish in it unsafe to eat. Every state now has mercury fish advisories, covering millions of lake acres and hundreds of thousands of miles of rivers.</p>
<p>Available and affordable technology can reduce mercury emissions from existing facilities by 90%, but the government doesn’t require it and the coal industry would rather poison you and your children than spend the money necessary to reduce the amount of toxic mercury in our environment. The truth is that it’s time for the coal mining and power companies to stop pointing fingers and start taking responsibility for polluting our lakes, rivers, and streams, our fish and our children.<br />

FRANKFORT, KY.</strong> — Without explanation, the Beshear administration on Tuesday fired Carl Campbell as commissioner of the state Department for Natural Resources.<br />
Campbell was notified in a brief letter from the Energy and Environment Cabinet’s personnel office that his services “are no longer needed.”<br />
The letter, released late Tuesday by the cabinet, says Campbell — who was a non-merit political appointee — was fired “without cause.”<br />
Asked about the reason for Campbell’s firing, Dick Brown, spokesman for Energy and Environment Secretary Len Peters, said the cabinet’s policy is not to comment on personnel matters.<br />

As promised, they have scheduled a follow-up meeting to accomplish the transition from information, to organizing for action.<br />

</em>The Sierra Club on Wednesday took the first step toward suing We Energies for violations of state environmental permits as a result of the bluff collapse and landslide that sent coal ash into Lake Michigan last week.<br />
A 1950s-era landfill of coal ash, created when ash and dirt were used to fill a ravine, gave way at the construction site for the utility’s air pollution control system.<br />

LOUISVILLE, Ky.</em> &#8211; A coalition of environmental groups unhappy with a settlement Kentucky officials offered to two coal companies for violations at Appalachian surface mines has filed federal lawsuits against the companies under the Clean Water Act.<br />
The four groups sought to block the settlement Frasure Creek Mining and ICG reached with Kentucky officials last year over water quality monitoring violations. They say the $660,000 total fine was too light a punishment for allegedly falsifying water discharge reports and releasing polluted water.<br />

In the meantime the House passed a bill preventing EPA from moving forward and the Senate is currently considering the same bill (S.1751). “How many coal ash spills are going to have to occur before Congress and the EPA acknowledge the very real dangers posed by this industrial waste? This is not some ‘freak accident,’ for a century billions of tons coal ash has been buried, piled and ponded without regulation and without consideration of the consequences.  We’re coming up on the three-year anniversary of the TVA coal ash disaster and it is disheartening that we still have no measures in place to protect the public against toxic ash.<br />
“While we wait for yet another clean-up, we’re battling Senate polluter benefactors who deny that coal ash is anything but mud. If this Senate legislation sees the light of day it must be stopped in its tracks by the White House. This event must be a wake-up call for our government to take action now.&#8221;</p>

“This scheme is illegal and defies common sense,” said Aimee Erickson, Executive Director of the Citizens Coal Council. While the many devils in the yet-to-be-released details of the Salazar OSM-BLM merger scheme already raise many serious and practical objections, the illegality of the proposed bureaucratic<br />
entanglement makes the proposal a non-starter.<br />
Alabama-based Hurricane Creekkeeper John Wathen adds, &#8220;Even though Secretary Salazar has already refused to fully enforce the federal law that requires OSM to protect communities, land, water and wildlife against abuses by the coal mining industry, it is shocking that he would now propose to bury this half-alive<br />
independent regulatory agency inside the Bureau of Land Management, whose mission includes promoting coal development.”<br />
&#8220;We are concerned that one of the motives for the Obama administration&#8217;s effort to destroy OSM&#8217;s independent regulatory status is to capture, and use for deficit reduction, the billions of dollars in coal industry fees OSM administers to clean up some of the thousands of miles of poisoned streams caused by abandoned coal mines,” stated Erickson.<br />
&#8220;Secretary Salazar and the White House know that eliminating OSM&#8217;s independent regulatory role and<br />
taking the Abandoned Mine Lands Fund are blatantly illegal, so they are really sending a signal to the Super Committee to use its deficit reduction authority to weaken OSM&#8217;s environmental protection and dilute BLM&#8217;s resource management effectiveness in ways that Congress itself would never allow.&#8221;<br />
“Senator Lisa Murkowski (R-AK) is quite correct in her understanding of federal law in stating that<br />
Congressional approval is required to make any such changes to OSM,” said Ms. Erickson. As Sen. Murkowski elaborated in her press release of Oct. 27: “OSM was specifically established as a separate entity, reporting directly to the Interior Secretary, to protect its independence as a regulatory body. I want to make sure that&#8217;s protected. The proposed merger of BLM – the entity responsible for leasing – and OSM – the regulatory body, seems to fly in the face of the arguments DOI used to support establishing the Bureau of Safety and Environmental Enforcement as an independent entity to regulate offshore oil development, separate from <a href="http://energy.senate.gov/public/index.cfm?FuseAction=PressReleases.detail&amp;PressRelease_id=4c6304d0-e3f7-4f17-9af0-%20%205aa6b712f823">BOEMRE,</a> which handles offshore leasing.”<br />
Numerous organizations, from national-level to small grassroots groups, from every region of the United States echo these concerns. “Westerners have seen the poor reclamation performance of BLM in the areas of hardrock mining, coalbed methane, oil and gas development, and uranium; we do not believe that a merger of OSM into BLM will improve OSM‟s efforts in coal reclamation. Secretary Salazar wants to merge an l872 law with a modern law, and the results will be unfortunate,” said Ellen Pfister a Montana rancher and member of the Northern Plains Resource Council Coal Task Force. While Secretary Salazar also states that the move is in the interest of making the most of limited resources,‟ the Citizens Coal Council asserts that any so-called savings claimed by the Obama Administration‟s scheme will be illusory.<br />
Secretary Salazar expressly states in his memorandum to the Directors of the OSM and the BLM that he will seek input from the White House, the Office of Budget and Management, employees and applicable congressional committees. However, as Ms. Erickson pointed out, “it adds insult to injury that the Secretary didn‟t even consult with America‟s coalfield citizens, and we are the ones who will be affected the most.”</p>

<p>The Environmental Protection Agency has delayed by one month final action on regulations that will reduce pollution from some of the nation&#8217;s oldest coal-fired power plants, including two in Southwest  Virginia. But further delays sought by power companies are unlikely, the EPA said.<br />
&#8220;Federal standards on toxic pollution from power plants are decades overdue and &#8230; will save thousands of lives and prevent tens of thousands of asthma attacks and other respiratory diseases,&#8221; the agency said in a statement.<br />
At issue are regulations that would force power plants to curb emissions of mercury, arsenic, acid gases and other airborne toxins.<br />
According to the EPA, the rules will prevent more than 17,000 untimely deaths a year caused by breathing air laced with fine particles and pollutants from the burning of coal to produce electricity. <a href="http://www.roanoke.com/business/wb/300265">Read more.</a></p>

One fight is taking place over a proposed terminal near Bellingham, Wash. And if you want to get a sense of what the proposed coal terminal there would be like, visit Westshore Terminals just across the border in Vancouver, B.C.<br />

</strong>The U.S. House of Representatives passed a misguided bill last week that would block the U.S. Environmental Protection Agency from regulating coal ash.<br />
The bill likely won&#8217;t come to a vote in the Senate, but it sends a signal that some lawmakers haven&#8217;t learned any lessons from the 2008 ash spill at the <a href="http://www.knoxnews.com/news/topic/kingston-fossil-plant/">Kingston Fossil Plant</a>.<br />
Regrettably, East Tennessee&#8217;s four congressmen voted in favor of the bill. Even U.S. Rep. Scott DesJarlais, R-Jasper, whose district includes the Kingston plant, voted to undermine EPA&#8217;s regulatory authority. The vote coincided with the end of testimony in a civil trial in federal court over the Kingston ash spill.<br />
The power industry has long looked at coal ash as an afterthought, but the Kingston disaster, in which 5.4 million cubic yards of coal ash sludge spilled from a ruptured retention facility, brought the issue of handling the waste to light. <a href="http://www.knoxnews.com/news/2011/oct/20/house-vote-to-strip-the-epa-of-authority-over/">Read more.</a></p>

<p><em>Neutering EPA’s ability to regulate toxic coal ash serves only corporate polluters</em></p>
<p>Washington, D.C. – The U.S. House of Representatives voted <strong>267-144</strong> today to pass H.R. 2273, a misguided attempt to neuter the Environmental Protection Agency’s attempt to set the first ever federal regulations on coal ash. Despite evidence showing groundwater contamination from arsenic, lead and other toxic metals at hundreds of sites and a recent study showing that federal coal ash regulations would <a href="http://sei-us.org/publications/id/410">create 28,000 new jobs</a> every year, the House voted to put the interests of corporate polluters ahead of the American public.</p>
<p>The following statement is from Trip Van Noppen, president of Earthjustice:</p>
<p>“Nearly three years after the tragic spill of more than 1 billion gallons of toxic coal ash in Kingston, Tennessee, it’s obvious that federally enforceable safeguards for the disposal of this toxic waste are long overdue. In fact, 267 members of the House of Representatives have taken the disturbing step of moving us even further away from this important public safety goal.</p>
<p>“This Congress is turning their backs on what hundreds of communities living near coal ash ponds and landfills really need. Instead, these elected officials are paying attention only to the needs of corporate polluters intent on preserving their old, dangerous way of doing business. Coal ash is a toxic menace. We cannot afford another spill like the one in Tennessee, and the cold truth is that there are dozens of sites that could become another tragedy any day. Moreover, at hundreds of other coal ash sites, drinking water is contaminated with toxic heavy metals that can cause cancer and other disease.</p>
<p>“A recent study by <a href="http://sei-us.org/publications/id/410">Tufts University</a> found that federal regulations for coal ash could provide 28,000 new jobs every year. At a time when our economy is struggling and so many Americans are out of work and trying to make ends meet, it’s shameful that 267 members of the House are turning their backs on real jobs. Rather than acting to protect America’s health and environment, it’s obvious that some members of Congress are only acting to protect polluter profits.”</p>

A coalition of environmental and conservation organizations announced the agreement Monday, saying the deal would hold the St. Louis-based company responsible for damage it&#8217;s already done and prevent more.<br />
The settlement could help address the declining water quality and diversity of aquatic life that the West Virginia Highlands Conservancy called &#8220;totally unacceptable.&#8221;<br />

<strong>Two Waterkeeper Groups Sue Black Warrior Minerals&#8217; Fleetwood Mine in Tuscaloosa </strong><br />
Tuscaloosa &#8211; Nonprofit Waterkeeper organizations Black Warrior Riverkeeper and the Friends of Hurricane Creek filed a lawsuit today against Black Warrior Minerals, Inc. in United States District Court.  The lawsuit alleges that pollution from Black Warrior Minerals&#8217; Fleetwood Mine in Tuscaloosa County is polluting Hurricane Creek, a tributary of the Black Warrior River.<br />
According to John Wathen, Hurricane Creekkeeper for the Friends of Hurricane Creek, &#8220;Coal mining has been a serious problem in Hurricane Creek for many generations causing it to be placed on the EPA&#8217;s impaired streams list. Black Warrior Minerals has not only failed to reduce those pollutants but has exceeded effluent standards repeatedly and should be held accountable. The state has failed to do so. With no recourse left, we have joined forces with Black Warrior Riverkeeper to step in to enforce the laws.&#8221;<br />
Nelson Brooke, staff Riverkeeper at Black Warrior Riverkeeper, added, &#8220;Fleetwood Mine&#8217;s numerous violations of the Clean Water Act at Hurricane Creek and its tributaries are unacceptable.  Orange, polluted water flowing from this strip mine is an unwelcome sight along this beautiful stretch of Hurricane Creek.  Coal mines like this one should not be allowed to operate if they cannot meet applicable effluent standards.&#8221;<br />
Black Warrior Minerals is in violation of the Clean Water Act (CWA), which prohibits their Fleetwood Mine from discharging pollutants to waters of the United States except in compliance with applicable New Source Performance Standards (&#8220;NSPS&#8221;) for coal mining.  In their complaint, the two Waterkeeper Alliance member groups catalogued over 1,200 NSPS violations at the Fleetwood Mine over the past five years.  The mine has violated standards for iron, manganese, total suspended solids and pH.<br />
Black Warrior Riverkeeper and the Friends of Hurricane Creek are asking the Court to enjoin Black Warrior Minerals from discharging pollutants from Fleetwood Mine in violation of the CWA and to assess appropriate penalties for the violations alleged.  Most citizen suits require a sixty day waiting period before suit can be filed.  However, in this situation, David Ludder, counsel for Friends of Hurricane Creek explains, &#8220;Congress authorizes immediate citizen suits to enforce NSPS rather than allowing those violations to continue.&#8221;<br />

The hearing against the Kentucky Energy and Environment Cabinet, and ICG and Frasure Creek coal companies wrapped up last Friday. Appalachian Voices, Kentuckians for the Commonwealth, Kentucky Riverkeeper, and Waterkeeper Alliance intervened in the settlement between the Cabinet and the coal companies, arguing the settlement was not fair, reasonable or in the public interest. Appalachian Voices has identified more than 20,000 Clean Water Act (CWA) violations committed by the two companies between 2008 and 2009. Additional violations have been identified in 2011, but are the subject of a separate Notice of Intent to sue. Under the CWA, the violations could result in fines of more than $740 million dollars. The Cabinet originally fined the two companies a total of $1.25 million, but negotiated a consent judgment of $660,000 — $310,000 for Frasure Creek and $350,000 for ICG. <strong>Kentucky Coal Company Falsifies More Water Monitoring Data, Advocates Allege<br />
</strong>Coalition To Sue Mining Company In Latest Revelation of a Pattern of Violations.<br />
EASTERN KENTUCKY (August 23, 2011)— Newly discovered information suggests that coal company Nally and Hamilton has filed even more false – and potentially fraudulent – water pollution monitoring data with state agencies than previously believed, according to a coalition of clean water advocates. As a result, residents of Kentucky do not know how badly polluted their water is.<br />
Based on a review of state water monitoring reports, the coalition identified more than 5,000 additional violations of the Clean Water Act on top of the 12,000 violations previously discovered in March. Appalachian Voices, Kentuckians For The Commonwealth, Kentucky Riverkeeper and Waterkeeper Alliance today sent Nally and Hamilton a 60-day notice of intent to sue the company over these additional Clean Water Act violations with potential penalties of more than $180 million.<br />
“The undeniable pattern of coal companies blatantly disregarding the law in Kentucky is nothing new to our coalfield citizens,” said Suzanne Tallichet with Kentuckians For The Commonwealth. “Their ongoing pollution of the rivers and streams that our citizens rely on for drinking water is precisely why more and more health studies link mountaintop removal coal mining to a whole host of human health impacts from cancer to birth defects in babies.”<br />
Just like the previous violations discovered in March, the new information shows the company used the same data in permit reports month after month, rather than submitting the results of any monitoring and testing that it might have done. This is a continuing problem that has occurred at more than a dozen Nally and Hamilton operations in five eastern Kentucky counties from October 2006 through March 2011, according to the coalition. These groups previously identified the same pattern of violations committed by ICG and Frasure Creek coal companies, which also submitted false or fraudulent water monitoring data.<br />
“In the last 10 months we uncovered more than 41,000 Clean Water Act violations from three coal companies in Kentucky,” said Donna Lisenby, Director of Water Programs for Appalachian Voices. “With the filing of this fourth notice of intent to sue, it is undeniable that there is a clear pattern of Clean Water Act violations and yet no one in any government agency discovered these violations or brought enforcement action until we exposed the blatant lawlessness.”<br />
State permits allow Nally and Hamilton, and other companies, to discharge limited amounts of pollutants into streams and rivers but require the companies to carefully monitor and report these polluted discharges. The coalition uses these publicly available reports to check on the companies.<br />
“The abysmal failure to hold coal companies accountable to the law, a law put into place to protect our citizens from poisonous discharges being illegally dumped into our waters, has been so complete in Kentucky that I am stunned. Are we to conclude that our government is nothing more than a willing accomplice who aids and abets coal companies when they illegally dump their poison and waste in our Kentucky waterways? What message are they sending to the companies that are in compliance? Other industry leaders are furious at this double standard,” said Pat Banks, the Kentucky Riverkeeper.<br />
According to the coalition, Nally and Hamilton’s discharge reports suggest that the company cut-and-pasted previous sets of data in later reports rather than monitoring the discharge and submitting accurate data for each month. It also omitted legally-required data from its reports.<br />
“Every time we exposed the violations by Nally and Hamilton, ICG, and Frasure Creek mining in October, March, and June, the state agency said they would start reviewing water test results submitted by coal companies and start enforcing the law,” said Marc Yaggi, Executive Director of Waterkeeper Alliance. “They had the same opportunity we did to find and bring an enforcement action for these newly discovered Clean Water Act violations, but instead of them stepping up and announcing their own legal action today, we have to do their job for them – no one in government seems to have the backbone to make coal companies abide by the law in Kentucky.”<br />
Falsifying monitoring reports is another in a long list of recent allegations against the coal industry, which is under widespread pressure to clean up its destructive practices and take responsibility for its enormous and devastating ecological footprint.<br />
“State officials in our Department of Natural Resources and Division of Water are supposed to protect citizens and the environment from lawless acts by scofflaw polluters,” Tallichet said. “Instead they are part of the overall problem that we intend to resolve through legal action. That is our right and duty as U.S. citizens under the Clean Water Act.”<br />
Under the Clean Water Act, the company has 60 days to respond to the allegations made in the notice letter. If all violations have not been corrected at the end of 60 days, or the state has not preempted the suit, the groups plan on filing suit. The plaintiffs are being represented by lawyers with the Natural Resources Defense Council.<br />

BIG BRANCH, KY— Denise Howard doesn&#8217;t want to leave her Pike County home where she&#8217;s lived since 1995 but she may not have a choice.<br />
Howard, 36, and her husband, Calvin, 37, have been without water since May when their well caught fire from methane from a nearby mine operated by Excel Mining, a subsidiary of Alliance Resource Partners. The well burns continuously and state inspectors have determined the well was “mine impacted.”<br />
Under state law, Excel has to provide the Howards with emergency drinking water, which it has done. But Denise Howard said they conserve it because“we know now how precious water is.”They only use it for cooking, drinking water and brushing their teeth. <em>EIP and PRN “Name Names” of 12 Illinois U.S. Representatives Siding With Coal Industry Over Constituents Impacted by 22 Coal Ash Pollution Sites – 2<sup>nd</sup> Largest Concentration in the U.S.<br />
</em>CHICAGO, IL.///August 17, 2011//</strong>Eleven members of Illinois’ Congressional delegation are working to block the U.S. Environmental Protection Agency (EPA) from cleaning up toxic coal ash dump sites, even though Illinois has the second highest concentration in the U.S. of such pollution problems and in spite of the fact that state officials are doing nothing to clean up the problem, according to a  major new report released today by the Environmental Integrity Project (EIP) and Prairie Rivers Network (PRN).<br />
Titled <strong><em>“Illinois at Risk,”</em></strong> the EIP/PRN report concludes:  “Coal combustion waste or ‘coal ash’ is a toxic byproduct of electricity generation that is contaminating water supplies and harming communities across Illinois due to the lax regulation by the state in the absence of minimum federal standards.  Illinois has the second highest number of contaminated coal ash dump sites in the United States.   Data from groundwater sampling conducted by the Illinois Environmental Protection Agency (IEPA) at coal ash disposal sites in 2010 is now available, and the results are grim. IEPA found exceedances of health standards for contaminants commonly found in coal ash in groundwater at all 22 sites evaluated in the state. Yet, in spite of years of documentation demonstrating that coal ash is polluting groundwater in communities across the state, Illinois regulators have done little to prevent or correct these ongoing problems.”<br />
The report documents 22 total cases and highlights 10 case studies from the Illinois communities of Joliet, Venice, Hutsonville, Coffeen, Industry, Murdock, Vermilion, Coulterville, and Farmersville.<br />
The report finds that, as part of a broader move by some in Congress to roll back clean water protections, 12 members of Illinois’ Congressional delegation – Reps. Peter Roskam (R-6<sup>th</sup>), Joe Walsh (R-8<sup>th</sup>), Robert Dold (R-10<sup>th</sup>), Adam Kinzinger (R-11<sup>th</sup>), Jerry Costello (D-12<sup>th</sup>), Judy Biggert (R-13<sup>th</sup>), Randy Hultgren (R-14<sup>th</sup>), Donald Manzullo (R-16<sup>th</sup>), Robert Schilling (R-17<sup>th</sup>), Aaron Schock (R-18<sup>th</sup>), and John Shimkus (R-19<sup>th</sup>) &#8212; have voted to strip EPA’s ability to finalize ongoing rulemaking that would provide Illinois residents relief from toxic coal ash pollution.<br />
Commenting on the findings, Traci Barkley, water resources scientist, Prairie Rivers Network, Champaign, IL., said:<strong> “When lead was discovered to be hazardous, it was taken out of paint and gasoline.  When asbestos was discovered to be dangerous, we stopped using it in our building materials.  Now that the scientific evidence is in on coal ash, we know coal ash is toxic and needs to be disposed as such.  The elected officials who still think it can be handled with fewer protections than household garbage obviously do not have Illinois residents’ best interests in mind.”<br />
</strong>Jeff Stant, director, Coal Combustion Waste Initiative, Environmental Integrity Project, Indianapolis, IN., said:  <strong>“This is a clear case of elected officials siding with a dirty industry at the direct expense of the health of their own constituents. Even though major coal interests are mostly located outside of Illinois, the pain that would be felt by blocking the EPA from enforcing the Clean Water Act would be felt most acutely by resident of Illinois.   Illinois is a perfect example of why the federal EPA needs to be allowed to do its job when it comes to toxic coal ash pollution.”</strong><br />
Matt Wasson, director of programs, Appalachian Voices, Boone, NC, said: <strong> &#8220;In addition to voting to block EPA&#8217;s ability to update rules on coal ash, many members of Illinois&#8217; delegation have voted to loosen regulations on the devastating practice of mountaintop removal coal mining in Appalachia. It&#8217;s hard to understand why these members would be supporting mountaintop removal and the greatest assault on the Clean Water Act in the 40 year history of that law, and I don&#8217;t think it&#8217;s because their constituents want them to.&#8221;<br />

How serious is the toxic coal ash dump site problem in Illinois?<br />
According to the report: “Groundwater was contaminated at all 22 (Illinois) sites evaluated with results showing exceedances of at least one and usually more health standards such as drinking water standards (Maximum Contaminant Levels or MCLs) or health advisories set under the federal Safe Drinking Water Act in the groundwater underneath all disposal sites.   Monitoring data obtained from IEPA by the Environmental Integrity Project showed that arsenic concentrations were 15 times over the MCL in groundwater under the Meredosia Station’s ash ponds, more than nine times over the MCL under the Dallman Station’s ash ponds, and around five times higher than the MCL in groundwater contaminated by ash ponds at the Pearl and Waukegan Stations.  Lead was exceeding the MCL in groundwater under ash ponds at the Joppa and Powerton Stations.  Antimony was at least twice the MCL in groundwater contaminated under ash ponds at the Waukegen and Joliet 29 Stations.”<br />
The EIP/PRN report notes that, if federally enforceable safeguards were applied to transport, storage and disposal of coal ash, the Illinois problem sites most likely would not have occurred as proper site assessments, tracking and monitoring and pollution controls such as covers, liners and cleanup standards would have been required.<br />

A new study finds that state regulations regarding coal ash disposal are inadequate to protect public health and drinking water supplies for nearby communities. The information comes as federal regulations—the first of their kind—are under attack by a hostile Congress bent on derailing any effort to ensure strong, federally enforceable safeguards for coal ash, America’s second largest industrial waste stream.<br />
Earthjustice and Appalachian Mountain Advocates (formerly the Appalachian Center for the Economy and the Environment) today released “State of Failure: How states fail to protect our health and drinking water from toxic coal ash,” an exhaustive review of state regulations in 37 states, which together comprise over 98 percent of all coal ash generated nationally.
