More than 20 members of the Moapa Band of Paiutes and other tribes from Nevada, Utah and Arizona trudged over rocky trails and a dirt road that cuts across federal trust lands that have belonged to the Paiutes since 1875 and where they lived for centuries before that.

Protect Birmingham’s Drinking Water: Say No to the Shepherd Bend Mine
Shepherd Bend Mining, LLC is proposing an expansive strip coal mine, substantially located on property belonging to the University of Alabama, and directly across from the Birmingham Water Works Board’s Mulberry Fork drinking water intake. There is a high potential for hazardous mining-related pollutants to contaminate the river right across from Birmingham’s drinking water intake, as well as threaten the water quality, wildlife habitat, recreation, aesthetics and way of life for residents along the Black Warrior River. The mine is proposed to be an immense 1,773 acres with 29 discharge points. Shepherd Bend Mining, LLC is owned by members of the Drummond Coal Company family.<del datetime="2011-09-21T11:47" cite="mailto:Allie%20Klein"> </del>

Release date: 4/16/2012
Contact Information: Davina Marraccini, (404) 562-8293 , marraccini.davina@epa.gov

(ATLANTA – April 16, 2012) In response to requests from the Commonwealth of Kentucky, EPA will hold three public hearings in June to hear from stakeholders and the public about what actions to take on 36 draft individual National Pollutant Discharge Elimination System (NPDES) permits for coal mining discharges in Kentucky. EPA filed a “specific objection” to each of these 36 permits because it was concerned that the draft permits would not protect water quality, the environment and human health consistent with the Clean Water Act (CWA).
One hearing will be held on June 5 at the Frankfurt Convention Center from 7 to 11 p.m..; and two will be held on June 7 at the Eastern Kentucky Expo Center – the first from noon to 4 p.m. and the second from 7 to 11 p.m.
Since 2009, the Kentucky Department for Environmental Protection’s Division of Water (KDOW) has authorized discharges from approximately 2,500 existing and new coal mining and processing projects under the Clean Water Act, mostly under an approved coal general permit. KDOW requires individual NPDES permits for mining or processing activities that discharge pollutants into waters that are already polluted and are not meeting water quality standards, along with new or expanding mines within five miles upstream of a drinking water intake. In the last three years, KDOW has issued 115 such individual permits.
For the 36 individual permits that are the subject of the hearings, EPA has been working with KDOW to collect and evaluate data on toxic metals, cyanide, phenols, specific conductance, and current biological health of the waters that receive discharges from the mines in an effort to work through the issues identified in the objections.
“Our intent is not to stop coal mining, but to ensure it proceeds in an environmentally acceptable way,” said EPA Region 4 Administrator Gwen Keyes Fleming. “We are holding these hearings on our permit objections to hear from those directly impacted and are hopeful that, following the hearings, the remaining 36 permits will be developed by KDOW with appropriate site-specific controls that will allow these projects to move forward while protecting human health and water quality as required by the CWA.”
Persons interested in attending a hearing are encouraged (but not required) to pre-register at least 72 hours before the hearing online or by calling 703-577-4953 . When pre-registering, persons may request to speak at one of the hearings or they may sign up to speak in person on the day of a hearing, however, space is limited. People may also contribute comments, statements, data and other information to EPA regarding the specific objections in writing at any of the hearings, and either electronically or by mail by following the instructions on the website.
After careful consideration of all oral and written comments, data and the requirements of the Clean Water Act and applicable regulations, the EPA will determine whether to reaffirm, modify the terms of or withdraw each of the objections. For permits which EPA either reaffirms the original objection or modifies the terms of the objection, KDOW must, within 30 days, submit to EPA a revised permit that meets the terms of the remaining objection, or exclusive authority to issue the permit passes to EPA for one permit term. For any permits that EPA withdraws its objection, KDOW may proceed with the permit issuance process.
Instructions to register for the hearings and submit written comments, along with copies of KDOW’s 36 draft NPDES permits, fact sheets and specific objection letters, are available online at:www.epa.gov/region4/kycoalminehearings

Associated Press-U.S. coal exports reached their highest level in two decades last year as strong demand from Asia and Europe offered an outlet for a fuel that is falling from favor at home.
U.S. Department of Energy data analyzed by The Associated Press reveal that coal exports topped 107 million tons of fuel worth almost $16 billion in 2011. That’s the highest level since 1991, and more than double the export volume from 2006.
Much of the increase went to slake the thirst of power-hungry markets in Asia, where rapid development has sparked what mining company Peabody Energy calls a “global coal super cycle” that heralds renewed interest in the fuel.
The AP’s analysis showed coal exports to South Korea leapt 81 percent last year to more than 10 million tons. India saw a 65 percent jump, to 4.5 million tons. And Japan bought almost 7 million tons – a 119 percent increase – as the nation sought alternatives to nuclear power after an earthquake and tsunami prompted the Fukushima nuclear complex meltdown. Read more.

Railroads, which haul about 70 percent of U.S. coal, could also try to mitigate the damage from lower shipments to utilities by carrying more coal for exports. Read more.

ALBUQUERQUE, N.M. — A two-year legal battle over the disposal of millions of tons of coal combustion waste in northwestern New Mexico is on the verge of being settled with a $10.2 million agreement announced Wednesday by the Sierra Club, a BHP Billiton mining company and the state’s largest electric utility.
Settlement documents were filed by the groups in U.S. District Court in Albuquerque. The agreement is awaiting approval from a federal judge.
The settlement calls for about $8 million to be spent on structures that would prevent any contaminants from reaching the San Juan River as well as other environmental remediation projects. More than $2 million would cover the Sierra Club’s attorney and expert fees. Read more

By WILBUR WOOD - The Outpost
Fifteen trains a day, on average, rolled through Billings last year. If a passing train has interrupted your journey as you drove, bicycled or walked toward the tracks on 27th, 28th or 29th Streets North, downtown, you realize that this annoyance could turn to disaster if you were doing something like driving an ambulance from the south side of the tracks to reach one of the hospitals on the north side.
Now picture up to 40 more trains per day, either moving west heaped with coal bound for Asia or returning empty. These coal cars would fill up again in the Powder River Basin and other “Western Bituminous” coalfields in Montana and Wyoming, which now supply more than 42 percent of the nation’s coal. Read more.

March 6th, 2012 -Associated Press
NEW YORK — Shares of coal companies fell Tuesday as concerns deepened that global demand will continue to decline after China lowered its economic growth forecast.
Coal producers already have been hurt because electric companies have been switching from coal to cheap natural gas to fuel their power plants. Natural gas prices are hovering around a 10-year low because a mild winter cut into demand and supplies are plentiful.
The switch has caused coal supplies to grow and prices to fall, prompting several companies to cut back on operations to keep overhead costs low while they cope with soft market conditions. Read more.

Millennium Bulk Terminals is proposing to build a $600 million terminal west of Longview to export 44 million tons of coal annually, an amount that would make it one of the largest such facilities in North America.
The terminal would be a major shot in the arm for the area’s construction industry and its tax and employment base, and Millennium has promised to take steps to control coal dust and avoid traffic congestion.
But the proposal sparked an immediate attack from environmentalists, who raised the spectre of coal dust drifting over the community and traffic snarls caused by the mile-long trains that would deliver coal to the terminal daily. Read more.

TOLEDO — Environmentalists and charter fishing captains expect Lake Erie’s fish population to climb with the closing of coal-burning units at a power plant near the mouth of the lake’s biggest tributary.
The plant, which is being shut down by its operator because of new air pollution rules, sucks in billions of gallons of water each year and kills millions of fish near some of the lake’s most popular fishing spots.
Environmental groups have said for years that the fish kills have contributed to declining levels of both yellow perch and walleye, two prized fish that draw anglers from around the Midwest. The groups have tried to force the plant’s owner, Akron-based FirstEnergy Corp., to install costly changes that would stop millions of fish from being killed each year. Read more.

Report shows elevated levels near ash basins at 14 Duke and Progress power plants.
By Bruce Henderson – Charlotte Observer- Tuesday, Jan. 24, 2012
Elevated levels of metals have been found in groundwater near ash basins at all 14 N.C. coal-fired power plants, state regulators say after intensified monitoring.
Coal ash holds metals that can be toxic in high doses. But the elements most widely detected at the power plants, iron and manganese, also occur naturally and aren’t considered health risks.
State regulators now have to figure out which is affecting the wells.
Ash became an environmental lightning rod after a massive spill in East Tennessee in 2008. Utilities produce millions of tons of it a year, storing ash mixed with water in ponds or in landfills. Read more.

By Neela Banerjee, Washington Bureau
The Environmental Protection Agency is expected to approve a stringent cap on emissions of mercury and scores of other toxic substances from power plants, sources say. Utilities are expected to push back.
Reporting from Washington— The Environmental Protection Agency is expected Friday to approve a tough new rule to limit emissions of mercury, arsenic and other toxic substances from the country’s power plants, according to people with knowledge of the new standard.
Though mercury is a known neurotoxin that can be profoundly harmful to children and pregnant women, the air pollution rule has been more than 20 years in the making, repeatedly stymied because of objections from coal-burning utilities about the cost of installing pollution-control equipment.
Mercury emissions from the 1,100 U.S. coal-fired power plants account for more than 40% of all airborne mercury emissions in the nation. This mercury falls into our rivers, lakes and oceans – polluting our water, our food, our bodies and our babies. Just 1/70th of a teaspoon – a single gram – of mercury in a 25-acre lake can make the fish in it unsafe to eat. Every state now has mercury fish advisories, covering millions of lake acres and hundreds of thousands of miles of rivers.

Available and affordable technology can reduce mercury emissions from existing facilities by 90%, but the government doesn’t require it and the coal industry would rather poison you and your children than spend the money necessary to reduce the amount of toxic mercury in our environment. The truth is that it’s time for the coal mining and power companies to stop pointing fingers and start taking responsibility for polluting our lakes, rivers, and streams, our fish and our children.
WASHINGTON — A new Environmental Protection Agency regulation on power plant emissions due Friday promises to further inflame debate surrounding the Obama administration’s most polarizing arm — and could inflate Georgians’ utility bills in years to come.
Many utilities that rely on coal, such as Atlanta-based Southern Company, claim new regulations on mercury and other toxic emissions will cost the struggling economy dearly. Southern is the parent of Georgia Power and one of the most aggressive utility lobbies in Washington. Read more.

As the U.S. Environmental Protection Agency nears its Dec. 16 date with coal-fired power plants – that’s when the agency plans to finalize its mercury and air toxics rule – the lobbyists must surely be working overtime.

Environmental and public health groups say the rule, which would require significant reductions of emissions, is long overdue and should be implemented ASAP. And the industry says the rule is onerous and that it needs more time. Read more.

Tom Loftus | The Courier-Journal
FRANKFORT, KY. — Without explanation, the Beshear administration on Tuesday fired Carl Campbell as commissioner of the state Department for Natural Resources.
Campbell was notified in a brief letter from the Energy and Environment Cabinet’s personnel office that his services “are no longer needed.”
The letter, released late Tuesday by the cabinet, says Campbell — who was a non-merit political appointee — was fired “without cause.”
Asked about the reason for Campbell’s firing, Dick Brown, spokesman for Energy and Environment Secretary Len Peters, said the cabinet’s policy is not to comment on personnel matters.
Brown said deputy commissioner Larry Arnett will oversee the department until a new commissioner is appointed. Read more.

As he waited for sleep to come, the 61-year-old said his senses were jarred sometime before midnight as he felt his entire house shake. The Sierra Club on Wednesday took the first step toward suing We Energies for violations of state environmental permits as a result of the bluff collapse and landslide that sent coal ash into Lake Michigan last week.
A 1950s-era landfill of coal ash, created when ash and dirt were used to fill a ravine, gave way at the construction site for the utility’s air pollution control system.
The notice of intent was served on We Energies Wednesday, as a precursor to an enforcement action that would be filed in federal court in the coming months, said Jennifer Feyerherm of the Sierra Club in Madison. “We want to make sure that it’s cleaned up,” she said. Read more.

LOUISVILLE, Ky. – A coalition of environmental groups unhappy with a settlement Kentucky officials offered to two coal companies for violations at Appalachian surface mines has filed federal lawsuits against the companies under the Clean Water Act.
The four groups sought to block the settlement Frasure Creek Mining and ICG reached with Kentucky officials last year over water quality monitoring violations. They say the $660,000 total fine was too light a punishment for allegedly falsifying water discharge reports and releasing polluted water.
In September a judge in Frankfort asked the groups and the coal companies to meet with a mediator to attempt to reach a new settlement. Read more.

Coal Ash Spills into Lake Michigan in Wisconsin
EPA must pass regulations to protect public health from arsenic, lead and mercury
Washington, D.C. – On Monday coal ash spilled into Lake Michigan from a bluff near the We Energies Oak Creek Power Plant in Milwaukee County, Wisconsin. The EPA has stalled on plans to release the first-ever coal ash regulations that might have prevented this spill. In the meantime the House passed a bill preventing EPA from moving forward and the Senate is currently considering the same bill (S.1751). The following statement is from Earthjustice attorney Lisa Evans:
“How many coal ash spills are going to have to occur before Congress and the EPA acknowledge the very real dangers posed by this industrial waste? This is not some ‘freak accident,’ for a century billions of tons coal ash has been buried, piled and ponded without regulation and without consideration of the consequences. We’re coming up on the three-year anniversary of the TVA coal ash disaster and it is disheartening that we still have no measures in place to protect the public against toxic ash.
“While we wait for yet another clean-up, we’re battling Senate polluter benefactors who deny that coal ash is anything but mud. If this Senate legislation sees the light of day it must be stopped in its tracks by the White House. This event must be a wake-up call for our government to take action now.”

FOR IMMEDIATE RELEASE: October 30, 2011

CONTACT: Aimee Erickson, Citizens Coal Council Ph) 724-470-3982
Salazar plans to bury half-alive Office of Surface Mining!
(Bridgeville, PA) — Coalfield citizens throughout the United States join with Congressional leaders in rejecting the Obama Administration‟s announcement Wednesday, by Secretary of the Interior Ken Salazar, to merge the federal Office of Surface Mining, Reclamation and Enforcement (OSM) with the Bureau of Land Management (BLM).
“This scheme is illegal and defies common sense,” said Aimee Erickson, Executive Director of the Citizens Coal Council. While the many devils in the yet-to-be-released details of the Salazar OSM-BLM merger scheme already raise many serious and practical objections, the illegality of the proposed bureaucratic
entanglement makes the proposal a non-starter.
Alabama-based Hurricane Creekkeeper John Wathen adds, “Even though Secretary Salazar has already refused to fully enforce the federal law that requires OSM to protect communities, land, water and wildlife against abuses by the coal mining industry, it is shocking that he would now propose to bury this half-alive
independent regulatory agency inside the Bureau of Land Management, whose mission includes promoting coal development.”
“We are concerned that one of the motives for the Obama administration’s effort to destroy OSM’s independent regulatory status is to capture, and use for deficit reduction, the billions of dollars in coal industry fees OSM administers to clean up some of the thousands of miles of poisoned streams caused by abandoned coal mines,” stated Erickson.
“Secretary Salazar and the White House know that eliminating OSM’s independent regulatory role and
taking the Abandoned Mine Lands Fund are blatantly illegal, so they are really sending a signal to the Super Committee to use its deficit reduction authority to weaken OSM’s environmental protection and dilute BLM’s resource management effectiveness in ways that Congress itself would never allow.”
“Senator Lisa Murkowski (R-AK) is quite correct in her understanding of federal law in stating that
Congressional approval is required to make any such changes to OSM,” said Ms. Erickson. As Sen. Murkowski elaborated in her press release of Oct. 27: “OSM was specifically established as a separate entity, reporting directly to the Interior Secretary, to protect its independence as a regulatory body. I want to make sure that’s protected. The proposed merger of BLM – the entity responsible for leasing – and OSM – the regulatory body, seems to fly in the face of the arguments DOI used to support establishing the Bureau of Safety and Environmental Enforcement as an independent entity to regulate offshore oil development, separate from BOEMRE, which handles offshore leasing.”
Numerous organizations, from national-level to small grassroots groups, from every region of the United States echo these concerns. “Westerners have seen the poor reclamation performance of BLM in the areas of hardrock mining, coalbed methane, oil and gas development, and uranium; we do not believe that a merger of OSM into BLM will improve OSM‟s efforts in coal reclamation. Secretary Salazar wants to merge an l872 law with a modern law, and the results will be unfortunate,” said Ellen Pfister a Montana rancher and member of the Northern Plains Resource Council Coal Task Force. While Secretary Salazar also states that the move is in the interest of making the most of limited resources,‟ the Citizens Coal Council asserts that any so-called savings claimed by the Obama Administration‟s scheme will be illusory.
Secretary Salazar expressly states in his memorandum to the Directors of the OSM and the BLM that he will seek input from the White House, the Office of Budget and Management, employees and applicable congressional committees. However, as Ms. Erickson pointed out, “it adds insult to injury that the Secretary didn‟t even consult with America‟s coalfield citizens, and we are the ones who will be affected the most.”

By Laurence Hammack-Roanoke Times

The Environmental Protection Agency has delayed by one month final action on regulations that will reduce pollution from some of the nation’s oldest coal-fired power plants, including two in Southwest Virginia. But further delays sought by power companies are unlikely, the EPA said.
“Federal standards on toxic pollution from power plants are decades overdue and … will save thousands of lives and prevent tens of thousands of asthma attacks and other respiratory diseases,” the agency said in a statement.
At issue are regulations that would force power plants to curb emissions of mercury, arsenic, acid gases and other airborne toxins.
According to the EPA, the rules will prevent more than 17,000 untimely deaths a year caused by breathing air laced with fine particles and pollutants from the burning of coal to produce electricity. Read more.

Plans are afoot to build giant new coal terminals on the West Coast to ship this lucrative commodity to China. But activists want to stop this, in part because coal produces huge amounts of carbon dioxide when it’s burned. Federal climate policy is silent on this potentially large source of emissions, so the debate is happening at the local level.
One fight is taking place over a proposed terminal near Bellingham, Wash. And if you want to get a sense of what the proposed coal terminal there would be like, visit Westshore Terminals just across the border in Vancouver, B.C.
Trains a mile-and-a-half long rumble into this port, day and night, snaking through a large building. There, the trains roll onto a device that tips the coal cars over, two at a time, with the ease of a 5-year-old playing with a toy train. Read More/Hear Story.

Knoxville News Sentinel
The U.S. House of Representatives passed a misguided bill last week that would block the U.S. Environmental Protection Agency from regulating coal ash.
The bill likely won’t come to a vote in the Senate, but it sends a signal that some lawmakers haven’t learned any lessons from the 2008 ash spill at the Kingston Fossil Plant.
Regrettably, East Tennessee’s four congressmen voted in favor of the bill. Even U.S. Rep. Scott DesJarlais, R-Jasper, whose district includes the Kingston plant, voted to undermine EPA’s regulatory authority. The vote coincided with the end of testimony in a civil trial in federal court over the Kingston ash spill.
The power industry has long looked at coal ash as an afterthought, but the Kingston disaster, in which 5.4 million cubic yards of coal ash sludge spilled from a ruptured retention facility, brought the issue of handling the waste to light. Read more.

A bill sponsored by First District Congressman David McKinley that addresses coal ash passed a vote in the U.S. House of Representatives Friday.
House Bill 2273 is designed to provide a state-based regulatory framework for the disposal and management of coal ash. It was written in response to an EPA move last year to possibly classify coal ash as a hazardous material. The bill passed the House with support from nearly 40 Democrats. David McKinley is the first district’s congressman. “Ultimately, should this legislation become law, and new scientifically based factors arise, this legislation will allow for the flexibility for the states and the EPA to work together to adjust the coal ash program accordingly,” he said. Read more.

Neutering EPA’s ability to regulate toxic coal ash serves only corporate polluters.

IMMEDIATE RELEASE-October 14, 2011

Contact: Lisa Evans, Earthjustice (978) 548-8645
Jared Saylor, Earthjustice (202) 667-4500, ext. 5213

House Vote on Coal Ash Will Cost Lives, Jobs

Neutering EPA’s ability to regulate toxic coal ash serves only corporate polluters

Washington, D.C. – The U.S. House of Representatives voted 267-144 today to pass H.R. 2273, a misguided attempt to neuter the Environmental Protection Agency’s attempt to set the first ever federal regulations on coal ash. Despite evidence showing groundwater contamination from arsenic, lead and other toxic metals at hundreds of sites and a recent study showing that federal coal ash regulations would create 28,000 new jobs every year, the House voted to put the interests of corporate polluters ahead of the American public.

The following statement is from Trip Van Noppen, president of Earthjustice:

“Nearly three years after the tragic spill of more than 1 billion gallons of toxic coal ash in Kingston, Tennessee, it’s obvious that federally enforceable safeguards for the disposal of this toxic waste are long overdue. In fact, 267 members of the House of Representatives have taken the disturbing step of moving us even further away from this important public safety goal.

“This Congress is turning their backs on what hundreds of communities living near coal ash ponds and landfills really need. Instead, these elected officials are paying attention only to the needs of corporate polluters intent on preserving their old, dangerous way of doing business. Coal ash is a toxic menace. We cannot afford another spill like the one in Tennessee, and the cold truth is that there are dozens of sites that could become another tragedy any day. Moreover, at hundreds of other coal ash sites, drinking water is contaminated with toxic heavy metals that can cause cancer and other disease.

“A recent study by Tufts University found that federal regulations for coal ash could provide 28,000 new jobs every year. At a time when our economy is struggling and so many Americans are out of work and trying to make ends meet, it’s shameful that 267 members of the House are turning their backs on real jobs. Rather than acting to protect America’s health and environment, it’s obvious that some members of Congress are only acting to protect polluter profits.”
